From the supplier: Risk managers typically are not worried over forecasts that a hardening in the market for directors’ and officers’ liability (D&O) insurance will occur by 1998. Risk managers’ major concerns with D&O insurance lies in the construction of the policy itself. D&O insurance policies afford protection for directors and officers but provide little protection for the corporation itself. The uncertainty of language often leads to litigation between the D&O insurance policyholder which is the corporation and the issuing insurer over the allocation of monies from a settlement or judgement.
